Allgemeine Geschäftsbedingungen

1. general information

The following General Terms and Conditions of Business (GTC) between Protennis-training and its customers apply to all business relations, including all orders by telephone, fax, Internet, e-mail or letter. The version of the GTCs valid at the time of the order is always authoritative. These are therefore also valid for all future business conditions, even if they are not expressly agreed upon again. By placing an order, the customer accepts the following AGB.

 

2. registration

The registration is free of charge. There is no entitlement to admission to the online shop. The data required for registration must be provided completely and truthfully by the customer. The customer is responsible for updating his data himself. An info mail with current news or special promotions can be sent to the e-mail address provided during registration several times a year.

 

3. conclusion of contract

Orders placed by customers are confirmed by e-mail. A contract between the customer and Protennis-training only comes into effect with this confirmation of the order. Protennis-training is free to refuse to accept an order - for whatever reason - and to refuse to confirm it. By placing an order, the customer confirms the correctness of all information provided by him. The information provided in the Protennis-training sales documents or in the online shop (illustrations, drawings, dimensions, weights, product descriptions, tables of contents, prices and other services) are only to be understood as guidelines and do not constitute a guarantee of characteristics, unless they are expressly described in writing as binding.

 

4. prices

The prices are inclusive of the statutory value added tax applicable in Switzerland at the time and exclusive of shipping costs. The prices at the time of the order shall apply. The prices published in the sales documents are in USD. The shipping costs of the ordered goods are to be borne by the customer.

 

5. terms of payment

The purchase price is due for payment upon receipt of the order confirmation by Protennis-training. The customer pays according to the payment terms valid at the time of the order. Discounts and cash discounts are not permitted. No collection by third parties. A payment is only considered to have been made when Protennis-training can dispose of the amount. All deliveries are made under reservation of ownership. The goods remain the unrestricted property of Protennis-training until full payment of the purchase price, including all ancillary requirements. The Protennis-training association reserves the right to exclude individual persons from purchasing on account without giving reasons. The exclusion can also be made at a later date, after an order has already been placed on account. The customer will be advised of this measure by telephone or e-mail and at the same time informed of alternative payment options. Unless otherwise agreed, invoices are payable within 10 days strictly net. Protennis-Training is entitled to demand reminder fees in the amount of 1 reminder 10th, 2 reminder 15th and third reminder 20th. The right of Protennis-training to offset the enforcement of the claim by a debt collection agency or a lawyer remains unaffected. In the event of debt collection, all costs incurred by Protennis-Training for expenses and collection will be charged in full to the debtor.

7. right of withdrawal

If, after conclusion of the contract, one of the following factual reasons exists, Protennis-Training is entitled to withdraw immediately from the contract with the customer: 1. in the case of raw material defects 2. in the case of incorrect or untimely self-supply. This shall not apply in the event of non-delivery culpably caused by Protennis-Training. Protennis-training undertakes to inform the customer immediately if possible about the unavailability of the service. Services already exchanged, in particular a total price already paid by the customer, will be reimbursed immediately.

 

8. deposit of deliveries

With the handing over of the goods, respectively the depositing of the goods, benefit and risk, in particular the risk of theft, damage by third parties and environmental influences are transferred to the customer.

 

9. customer reviews

If you write a customer review, product review, or similar in the online shop or on other publicly accessible pages, you grant us the exclusive and unrestricted license for their further use. We reserve the right to display customer reviews after examination without comment, not at all or only for a period of time chosen by Protennis-training, shortened or changed, or to omit them completely. Give customer reviews or product reviews.

10. complaints, applicable law, place of jurisdiction

Any complaints by the customer must be made in writing to the association's address. Swiss law applies to this contract and to all disputes arising from this contract. The place of jurisdiction for any disputes arising from the business relationship is - if legally agreed - at the registered office of Protennis-training.

 

11. customer service and complaints

The Customer Service Department provides information and personal support as far as possible in the event of questions, problems or complaints regarding the services. Defects must be complained about immediately upon receipt of the goods. Otherwise the goods are considered to have been accepted by the customer as faultless. Hidden defects must be reported by e-mail to the customer service immediately after they are discovered.

 

12. duties of care of the customer

The Customer undertakes to provide true, exact, current and complete information about himself on the order form. Protennis-training excludes any liability for losses and damages resulting from the non-fulfilment of these obligations. We reserve the right to verify this information by recall or similar appropriate measures and, in the event of non-compliance with our terms and conditions, to exclude individual persons from the online ordering service.

 

13. data protection

The data collected will be treated confidentially and in good faith. On the occasion of the first contact, your data is collected in the form of personal information such as name, first name, address, email, telephone number for business purposes and for marketing purposes.
